Waverly Light and Power Issues Statement on Year Old Wind Turbine Accident: Utility files suit and seeks to bring matter to resolution

Statement Issued on Year Old Wind Turbine Accident

The Waverly Light and Power Board of Trustee’s were recently updated on litigation that continues on the Cannon II wind turbine matter. The turbine came to the ground in February 2009 however all persons were evacuated safely and damage occurred only to the wind turbine under construction.

Despite attempts, the various parties and insurance carriers have been unable to reach a resolution. On June 21, 2010, attorneys representing the Board of Trustees of the Municipal Electric Utility of the City of Waverly filed a lawsuit in the Iowa District Court for Bremer County against ICS, Inc. d/b/a Industrial Contract Services, Inc. ICS, Inc. responded to the lawsuit with a Counterclaim for the amount ICS, Inc. alleges is owed to it for completion of the Cannon I wind turbine.

“Waverly Light and Power feels it is in the best interest of our customers to pursue the matter,” said Diane Johnson, general manager. “To ensure the integrity of the legal process, the Waverly Light and Power Board of Trustees will meet in closed session each time issues pertaining to the ongoing case need to be discussed.”

Moving forward, Waverly Light and Power remains committed to utilizing renewable energy for the benefit of our customers. During 2010, a small solar array was installed at the utility building and the utility began purchasing a small amount of renewable energy from its supplier, the Municipal Energy Agency of Nebraska. Combined with these and the other two wind turbines, Skeets 4 located on the North edge of Waverly, and Cannon I on the east edge of Waverly, the utility produced 3.5% of Waverly’s needs with renewable energy to date this year.
